Anime Capsule X - Terms and Conditions
1. General
a) Use of this system implies that you agree to accept all conditions presented in this document
b) These terms and conditions may be updated from time to time, the most recent version of this document will always be located at http://ac3.metawerx.net/chat/terms.htm
c) Failure to comply with all Terms and Conditions may result in your account(s) being banned temporarily (suspended) or removed entirely.
2. Terms used in this document
a) Anime Capsule X - this chat realm, and all pages on the websites http://ac3.metawerx.net and http://ac3.metawerx.net
b) Administrators - people responsible for administering the chat rooms, disconnecting and banning users and removing accounts.
c) User - people accessing the chat service
d) Public Rooms - the rooms available on the Public Rooms list and on the login page.
3. Rules of Conduct
a) Users are not to make racist comments, utter racial slurs, or harass other users based on their race, belief or opinions.
b) If another user is annoying, you are able to ignore them using the 'ignore' feature, create a private room, or ban them from rooms that you own.
c) Any room owner is allowed to ban or bump other users from their room, for any reason.
d) Continued harassment of other users will result in instant removal of your account, at the discretion of the Realm Administrator.
e) You must not reveal personal information to other users, and if you do, this is entirely at your own risk.
f) You must not attempt to access accounts belonging to other users.
g) You must not attempt to gain access to Administrator-only commands or areas of chat.
h) You must not use personal information gained in chat to harass users in real life.
i) You must not reveal personal information about users to other users.
4. Minimum Age
a) The minimum age for users of Anime Capsule X is thirteen (13) years old. By using this system you agree that you are over 13 years of age.
5. Administrators
a) The administrators appointed to look after chat can be viewed using the /CHATADMIN command. These users are to be respected at all times, and are here as volunteers to make your online time more enjoyable.
b) The Realm Administrator is the head administrator over the Anime Chat Realm. Area Administrators for the Anime and RPZone areas have similar powers.
c) The Realm Administrator has the power to remove your account completely, and this decision will not be reversed.
d) Area Administrators have the ability to temporarily ban or disconnect users who are, in the opinion of the administrator, disagreeable, rude, dangerous or threatening, or for just about any other reason they see fit.
e) If an administrator bans your account temporarily, you may write to chat@metawerx.net to explain the circumstances.
f) Users will generally be warned by an administrator before being temporarily banned.
g) Users who are banned repeatedly risk losing their account permanently.
6. Content
a) You understand that this is a chat service, containing text written by many users in real time, and that the content of that chat cannot always be strictly controlled.
b) Your choice to leave the Public Rooms implies your understanding that other rooms may have uncensored content. Extra censoring is available using the user options or /CENSOR ALWAYS command. Censors are in place in all Permanent Rooms by default.
7. Enhanced Accounts and Donations
a) Enhanced accounts may be activated by making a donation of $14 or more per year to help keep Anime Capsule X running.
b) Enhanced accounts allow your Nijigen character to be saved, extra gold coins for use in the chat games, and certain other benefits on chat, such as clickable links in profiles and access to special features.
c) All donations received are treated as donations, and do not entitle you legally to any special treatment, features or changes to these Terms and Conditions.
d) It is entirely your responsibility to ensure that you follow the Terms and Conditions to prevent your account being removed by the Realm Administrator.
e) This chat may close at any time, and may also be offline from time to time for various reasons.
f) Donations are accepted in the following forms: manga comics, anime videos, cash, paypal, cheque, money order.
g) Under no circumstances will a refund be provided, donations are made in good-will for the benefit of Anime Capsule X to help pay for server costs and the cost of new developments.
8. Legal
a) We reserve the right to pass your personal information to government agencies, federal or local authorities in any country, should we be requested to by those government agencies or authorities.
b) Should any section of this agreement breach local conditions in Australian Law or the laws of any country, be found to be incomplete, erronneous, irrelevant or non-enforceable, the rest of the agreement remains valid and completely in force.
c) Anime Capsule X, it's employees and subsidiaries, are in no way legally responsible for anything that happens in relation to this system.
d) The Administrators are in no way legally responsible for anything that happens in relation to this system.
e) You agree not to hold Anime Capsule X, it's employees or subsidiaries, or the Administrators responsible for any claims or problems experienced through, or from, your use of Anime Capsule X.
f) You agree not to hold the developers of the InterChat chat software (metawerx - www.metawerx.net), it's employees or subsidiaries, responsible for any claims or problems experienced through, or from, your use of Anime Capsule X and understand that metawerx is separate to Anime Capsule X.
g) All and any legal proceedings arising out of your use of Anime Capsule X, or in relation to Anime Capsule X, will be held entirely in the state of Victoria, Australia.
9. Privacy of Information
a) We reserve the right to collect any information about you that we require in order to provide a better service.
b) We will do our best to keep secure any information we collect about you or your online time. Your information will not be sold or made available to any third parties or used internally for marketing purposes.
c) In the event that system security is breached, we cannot be held responsible for any consequential actions.
